PUBLIC OFFER AGREEMENT

This offer is public in accordance with Article 633 of the Civil Code of Ukraine (CCU) and governs the legal relationship between MYFREEDOM RENT LLC (the Administration), registered at: Kyiv, Nekrasova Viktora St., bldg. 12-A, apt. B171, EDRPOU code 45903689, and any individual or legal entity (the User) using the website https://myfreedom.rent/. Starting to use the Site constitutes acceptance of the Terms.

TERMS AND DEFINITIONS

  • Site — the web resource at https://myfreedom.rent, including all its pages, functions and content.
  • User — an individual with full civil legal capacity or a legal entity using the Site.
  • Landlord — an individual entrepreneur, owner or sublessee of property who places listings on the Site.
  • Request — an electronic or telephone request by the User to book or rent property through the Site or call center.
  • Content — texts, images, code, design and other intellectual property objects on the Site.
  • Public Offer Agreement — a public agreement, a sample of which is posted on the Site.
  • Prepayment — the payment made by the User when booking accommodation.
  • Messenger — software or a service (Viber, Telegram, WhatsApp) for exchanging messages during booking.

GENERAL PROVISIONS

MYFREEDOM RENT LLC provides access to the Site for searching, booking and renting property on a daily or long-term basis. The Administration provides the technical infrastructure and is not a party to rental agreements. Use of the Site is governed by these Terms, the Privacy Policy and the legislation of Ukraine.

PROCEDURE FOR USING THE SITE

  • Viewing property listings.
  • Submitting Requests through online forms or the call center.
  • Receiving consultations from the call center.

To submit a Request, the User must provide accurate data: full name, phone, email. The Administration forwards the Request to the Landlord for booking confirmation, the terms of which are determined between the User and the Landlord.

The User is prohibited from:

  • Using the Site for illegal purposes.
  • Using automated tools (bots, scripts) to collect data.
  • Making changes to the Content or functionality without the permission of the Administration.

BOOKING PROCEDURE

The User can make a booking by choosing dates, number of persons, price, reviews, etc. Only verified Landlords are presented on the Site.

By making a booking, the User accepts the terms, including:

  • The cancellation policy established by the Landlord.
  • Additional rules (age restrictions, security deposits, surcharges, accommodation conditions, etc.).

After booking, the Administration sends a message with detailed information: booking number, address, dates, cost, support contacts, accommodation conditions. The booking confirmation is an agreement between the User and the Landlord.

COST OF ACCOMMODATION AND PAYMENTS

  • Accommodation fee.
  • Taxes and charges (tourist tax).
  • Other payments provided by the Landlord.

Payment may be made by Visa, Mastercard, Apple Pay, Google Pay cards or another method. After payment, the Administration sends a receipt with the details and booking information. The prepayment may be non-refundable under the agreement between the User and the Landlord.

If payment is in another currency, the bank may charge a conversion fee, for which the Administration is not responsible.

RIGHTS AND OBLIGATIONS OF THE PARTIES

Rights of the User:

  • Access to information about the property.
  • Submitting Requests and receiving responses.
  • Contacting the Administration with questions.

Obligations of the User:

  • Comply with the Terms and the legislation of Ukraine.
  • Be responsible for the accuracy of the data.
  • Not harm the Site or its reputation.

Rights of the Administration:

  • Make changes to the design, structure, functionality of the Site without notice.
  • Temporarily restrict access for maintenance.
  • Terminate access in the event of a violation of the Terms or a security threat.

Obligations of the Administration:

  • Forward Requests to Landlords within a reasonable time.

LIABILITY OF THE PARTIES

The Administration is not responsible for:

  • The accuracy of information from Landlords.
  • The performance of rental agreements between the parties.
  • Losses from interruptions in the operation of the Site or force majeure.
  • Transactions concluded outside the Site.

The User is responsible for the consequences of inaccurate data and damage to third parties due to a violation of the Terms.

INTELLECTUAL PROPERTY

Materials on the Site (listings, photos, code, design) are intended only for personal non-commercial use.

All rights to the "MYFREEDOM" Trademark, Content and Software belong to MYFREEDOM RENT LLC or licensors in accordance with the Law of Ukraine "On Copyright and Related Rights".

The User is granted a non-exclusive license for personal use. It is prohibited to reproduce, distribute, modify the Content without the written consent of the Administration.

CHANGES AND TERMINATION OF THE TERMS

The Administration may change the agreement by posting a new revision on the Site. Changes take effect from the moment of publication.

If the User does not agree with the changes, they must stop using the Site.

The Administration may terminate access without notice in the event of a violation of the Terms or at its own discretion.

APPLICABLE LAW AND DISPUTE RESOLUTION

This agreement is governed by the legislation of Ukraine.

Disputes are resolved through negotiations within 30 calendar days, and then in court at the place of registration of MYFREEDOM RENT LLC.
